The role of MLC and Legislative Council in State Legislature process : In Telangana, recently the term Graduate MLC is become a hot topic. Because two graduate MLC seats are going to vacate by March,2020. So that Election Commission of India initiated a schedule to fill those vacancies. For the preparation Electoral rolls.

The process of enrolling for Graduate voters starting from 1, October 2020. For those who completed their degree 3years prior to 1 November, 2020 are eligible to apply as a voter.

Who is an MLC

In India some states have bicameral legislature. Besides, the lower house Legislative Assembly, the upper house is called as Legislative council. MLC is the member of Legislative Council or Vidhana Parishad.

Establishment of Legislative Council accordance with article 169 of Indian Constitution. In fact, there are only six states have Legislative Council along with Legislative Assembly. They are Andhra Pradesh, Karnataka, Bihar, Maharashtra, Telangana and Uttar Pradesh.

Creation and Abolition of Vidhana Parishad

According to article 169 of Indian Constitution. Parliament can either create or abolish the Legislative Council. In case, the state legislature of Assembly passes resolution to create or abolish it.

For instance, recently the Legislative Assembly of Andhra Pradesh passed a resolution to abolish the Legislative Council. On the other hand, creation of council pending in Rajya Sabha for Assam and Rajasthan.

The process to elect the members to Vidhana Parishad

Unlike legislative Assembly, Legislative Councils are permanent houses. The term of the MLC is for 6 years. Of course, 1/3 of its members retire by every two years.

However, the members of council is not more than 1/3 of legislative Assembly. While it’s least membership is 40. For example, in Telangana state there are 40 members in Legislative Council.

  • The members of Assembly (MLA’S) elect 1/3 of it’s council members.
  • Further members of local bodies elect another 1/3 of legislative council member.
  • Each of them from Teachers and Graduates elect 1/12 members of legislative council.
  • In fact, the Governor of the state also nominates 1/6 of Legislative Council members. Of course, they are the most experienced and experts. They are nominated from social service, co-operative movement, literature, science and art.

Further these members can chose one of them as Chairman and Deputy Chairman of Council.

Qualifications needed to become an MLC

  • To become an MLC a person must be citizen of India.
  • He must have at 30 years old and mentally sound as well.
  • He must be a registered voters in that particular state.
  • Most importantly he is not a member of Legislative Assembly and Parliament.

The role of Legislative Council while Preparing State Legislations

As like Lok Sabha in the parliament, money bill can be introduced only in Legislature Assembly. After introducing the money bill in Legislative Council. It should return back to Assembly with appropriate suggestions. Even though suggestions may not considered by Assembly.

In case, the money bill may not return to Legislative Assembly with in 14 days from legislative Council. Further, it is considered as accepted by both houses. With regarding to normal bills the council can adjourn it for maximum of 4 months time.

Mean while the Government may be change its mood about the bill or not. There is no scope for joint session in case of State legislature process.

What is the need of Legislative Council

Since the members of Legislative Council are representing from different groups of people. So that there may be a scope to members of Council. That bring notice to the Government about important, emergency and public related issues.

For this purpose, they use their experience in different fields. While giving suggestions and questioning the Government. On the other hand, some experts analyze that Legislative Councils are may be economically burden to the states.
